No Collusion? Leak Shows Mueller Wants To Ask Trump About It

Amid a week full of Russian Federation investigation bombshells that includes the revelation of Mueller's Trump interview question wish list and news the special counsel at least once threatened to subpoena the president, Panetta said the revolving door of lawyers won't stop the face-to-face meeting that's sure to come.

By the afternoon, White House press secretary Sarah Sanders adopted Trump's strategy, calling the investigation into Russian meddling in the 2016 election a "witch hunt".

There are modern precedents of Presidents having to comply with subpoenas (Richard Nixon) and having to testify before grand jury (Bill Clinton).

John Dowd, obviously anxious about where Mueller was going with the investigation, resigned from Trump's legal team right after the March meeting with Mueller.

Flood was always the top choice of White House counsel Don McGahn for the job Cobb was given last summer, according to a person familiar with the hiring decision who described Flood as a "fighter". John Dowd, then Trump's lead lawyer, was outraged.

Direct interaction between the president and the special counsel's office has been possible all along, and in an earlier phase, Trump said he wanted to talk with Mueller - if his lawyers said it was OK.

But other members of the legal team share Trump's view that they should take a more confrontational approach with the special counsel, including lawyer Jay Sekulow, who has urged the group to consider the pros and cons of fighting a subpoena, according to people familiar with his advice.

The Washington Post reported yesterday that in March Mueller told Trump's lawyers that he had the power to subpoena Trump if the president did not submit to an interview.

Now, however, as actual potential questions are being aired and talk of potential subpoenas is bandied about, the president is less enthusiastic.

Should Mueller threaten to subpoena Trump or accept written answers to the questions, and if Trump refuses to grant the interview request, then the nation is "headed to a constitutional crisis, because the president's not going to answer these questions under any set of circumstances", diGenova predicted. Trump initially said he was eager to be interviewed, but his perspective on Mueller soured a raid last month targeting his personal lawyer, Michael Cohen, in a separate investigation.

To Trump, it seems so much easier to fire the prosecutor.

Trump appears to be responding to frustrations from conservative Republicans that the Justice Department has not turned over documents related to controversial topics, including surveillance of former Trump campaign adviser Carter Page.

The two sides are battling to shape the public discussion about the president's legal dilemma and grab the attention of the principal himself.

Later, Caputo worked in the press shop of Trump's short-lived 1988 presidential campaign that was spearheaded, in part, by Stone, and the two reunited in 2015, during the nascent days of Trump's presidential run.

Meanwhile, whatever the skeletal remains of Trump's legal team actually believe, they are likely telling him what he wants to hear on this front as well. Mueller isn't going to give Trump a pass.

Alex Whiting, a former federal prosecutor who is now a professor at Harvard Law School, echoed that point, adding that the questions about obstruction pose a high risk for Trump because they relate directly to his conduct. "There's not many more bad precedents that you can have", he said, suggesting that the office is already about as weakened as it can get. A grand jury subpoena has always been the special counsel's trump card in the negotiations over a potential interview.

Trump has repeatedly offered contradictory explanations for his role in most of the events outlined above.

"A Rigged System - They don't want to turn over Documents to Congress", Trump tweeted. What are they afraid of? "Why such unequal 'justice?'" Trump tweeted Wednesday. "There was no Collusion (it is a Hoax) and there is no Obstruction of Justice (that is a setup & trap)", he wrote. "He loses. He'll have to testify", Sol Wisenberg, a Washington defense attorney who was deputy independent counsel in the Starr investigation, told me, pointing to the case law.

"You'd have to go through hoops at the Justice Department for permission to serve (a subpoena to), say, a journalist", he explained in an interview with WND and Radio America.
