Nintendo Is Investigated In The US for Alleged Switch Patent Infringement

Gamevice has invoked the Tariff Act of 1930 and requested a cease and desist order against Nintendo over unspecified alleged patent infringements relating to "controller systems with parts that attach to two sides of an electronic device".

Back in August 2017, Gamevice filed a lawsuit against Nintendo, claiming that the detachable controller design of the Switch infringed on its patents.

"The U.S. International Trade Commission (USITC) has voted to institute an investigation of certain portable gaming console systems with attachable handheld controllers and components thereof", the independent Federal agency writes. It's likely this will all blow over and we can all enjoy our Switches and Gamevices without one infringing on the other, but it's very much a story to keep an eye on. At least, this is the conclusion that can be drawn based on the fact that the lawsuit that the company lobbed at Nintendo was dropped shortly following its filing past year. Nintendo's Switch controllers and the Gamevice controllers do look similar on the surface.

However, the USITC release notes that an investigation does not necessarily mean that the complaint itself has any merit or validity. The latest company to get in trouble over this is Nintendo, which is now under investigation by the US International Trade Commission.

Gamevice is asking ITC to serve Nintendo with a "limited exclusion order" or a cease and desist order. The issue resides with its patents for detachable controllers that resemble the Switch's iconic Joy-Cons. It's also unlikely that the USITC will make any kind of decision that will favor Gamevice. The complaint will be assigned to a USITC administrative law judge who will hold an evidentiary hearing.

This isn't the first time that the Japanese console maker has been the target of complaints recently, as last week we reported that the company was being investigated for its non-compliant practices on the Nintendo eShop platform.
