Michigan State student sues school, claiming counselors discouraged her from reporting rape

The woman, who remains a student at MSU, alleges she was at Harper's Bar when the Spartans' basketball team arrived after midnight. The woman, who at the time was a sports journalism major, also said that one of the players "lied" to her and said her roommate was also going to be at the party.

A female student is taking her story to the courts, accusing the university of denying her of her Title IX rights and discouraging her from going to the police about an alleged rape committed by three MSU basketball players. She was also reportedly told her roommate was already headed to the party. According to the lawsuit, the alleged victim was having a hard time holding her drink even though she did not have that much to drink at that point in time.

She doesn't remember anything else, according to the lawsuit. Once at the apartment - and realizing her roommate wasn't there - the lawsuit states the woman felt "discombobulated" and "tried to send a phone text, but she could not control her thumbs to formulate a text". The alleged victim agreed and asked for water, as she was incredibly thirsty. Then the first player allegedly pulled her into a bedroom and told her, "You are mine for the night".

According to the lawsuit, the plaintiff was left so "traumatized, depressed, and withdrawn" that she was admitted to Sparrow Hospital outpatient psychiatric day program for intensive psychiatric treatment.

"I feel that because...like they have such a big future, they have a lot of promise that these students are handled, or these students are treated with some sort of privilege". He then allegedly raped her from behind while she cried, unable to move or speak, according to the lawsuit.

Shortly afterwards, the victim was taken into a bedroom where each player took their turn in raping her. When she woke up on the couch a few hours later, she called a taxi and went back to her dorm room.

USA Today reports that the case was filed in U.S. District Court for the Western District of Michigan Southern Division. "There was no party" the lawsuit stated, "as few people were present".

"The MSUCC staff made it clear to (the victim) that if she chose to notify the police, she faced an uphill battle that would create anxiety and unwanted media attention and publicity as had happened with many other female students who were sexually assaulted by well-known athletes", Monday's lawsuit, filed by attorney Karen Truszkowski, read.

"Comments were made by MSUCC staff to the effect of 'we have had many other students in the same situation who have reported, and it has been very traumatic for them'". She said she would see her attackers at the Brody Dining Hall, causing panic and flashbacks, according to the lawsuit. An "Outside the Lines" report in January accused the school of covering up a series of sexual-assault claims involving the athletic department. She later withdrew from the university for the fall 2015 semester and resumed classes in 2016 with a different major. The school has been at the center of the Larry Nassar scandal earlier this year, and ESPN reported that MSU's basketball and football programs mishandled reports of sexual assault since 2007.

The lawsuit is the latest black mark for Michigan State this year.

Michigan State is named as a co-defendant in civil lawsuits filed by more than 150 women, many of whom allege that coaches, athletic trainers and others at the school ignored complaints about Nassar for almost two decades.
