Tennessee teacher accused of kidnapping due in court Monday

Tennessee teacher accused of kidnapping due in court Monday

She says Elizabeth is in a mental health facility where she is being treated, so she spends a lot of time with a therapist while visitation with family & friends is limited.

Federal prosecutors in California, arguing against pre-trial release for Cummins, said the former teacher "planned and executed an audacious scheme" which would culminate in him taking Thomas to Mexico and points farther south "to further his own prurient desires".

He is scheduled to be arraigned in federal court in Sacramento, California, on Monday. The 15-year-old is now receiving treatment from mental health experts.

U.S. District Court Judge Kendall J. Newman ruled Tad E. Cummins is a violent danger to society and a flight risk.

"It is believed based on the investigation to date ... that Cummins, age 50, and VICTIM, age 15, are involved in sexual relationship and traveled in interstate commerce to continue their relationship and to engage in unlawful sexual activity", according to the affidavit.

Commune residents weren't shy when it came to talking about their time with Cummins and Thomas.

Cummins offered minimal responses as he was advised of his rights and the charges that could send him to prison for 10 years to life.

Kat Bozeman told News 2 that her 15-year-old sister still isn't quite home. "She's just so happy to get food and coffee and showering".

Cummins vanished from Columbia, Tennessee with the teenage girl on March 13.

Cummins also faces state charges of aggravated kidnapping and sexual contact with a minor. Cummins, too, was gone, after borrowing his wife's Nissan Rogue and having recently filled prescriptions for erectile disfunction medicine and securing a $4,500 loan.

One of Elizabeth's schoolmates reported seeing her and Cummins kiss in his classroom on January 23, according to a school district investigative report, but both denied the claim.

The pair went missing in March from Tennessee and were not seen for six weeks - except for when they were captured on surveillance video at a Walmart in Oklahoma City.
