South African court blocks government's International Criminal Court withdrawal bid

Pretoria had in 2015 announced its intention to leave after the ICC criticised it for disregarding an order to arrest Sudanese President Omar Hassan al-Bashir, accused of genocide and war crimes, when he visited South Africa.

But on Wednesday, the country's High Court struck yet another blow to the president when it rejected the government's bid to withdraw from the International Criminal Court.

South African Minister of justice, Michael Masutha on Wednesday said the country still plans to withdraw from the International Criminal Court (ICC).

The opposition Democratic Alliance, which launched the court challenge of the government's withdrawal from the ICC, said the ruling was "a victory for the rule of law". South Africa resisted pressure to arrest him, arguing he had diplomatic immunity.

"We feel the executive's decision was misguided and the court stamped the authority against the executive's subversion of the rule of law", says Ngari. "The postion is the one that we communicated to the general public and it is that Malawi, as a founding State Party, will remain and fight for reform in the ICC from within the ICC", said Kasaila.

The president and ministers "are ordered forthwith to invoke the notice of withdrawal", he added.

It is not clear whether the government would appeal the court's ruling.

A high court judge instructed the government to revoke its notice of withdrawal from the court based in The Hague, Netherlands.

In a boost for the ICC, however, Adama Barrow, the new democratically elected president of the Gambia, recently reversed that decision - made by Yahya Jammeh, the west African state's former authoritarian leader.

Essentially, the executive will now have to begin the process of withdrawal afresh, if they still wish to do so, and this time they would need to obtain Parliament's approval prior to taking any action. But the ANC, which has ruled South Africa since 1994 after the end of the Apartheid era, has shown signs of cracking under Zuma's scandal-plagued leadership.

The case hinged on a constitutional interpretation of the separation of powers between the executive and legislative branch of government.

They are accusing ICC of focusing on human right abuse in Africa while neglecting.

South Africa should follow the lead of Gambia, which recently cancelled its ICC withdrawal notice.
